Jurisdictional Guidelines Test

An application for a grant of aid will meet the Jurisdictional Guidelines Test if it relates to a matter that falls within the–

1. Family Law Guidelines
2. Child Protection Guidelines
3. Civil Law Guidelines or
4. Criminal Law Guidelines

The Chief Executive Officer of Legal Services may waive the Jurisdictional Guidelines Test in exceptional circumstances, such as the applicant’s personal circumstances or capacity to self-represent.

If the Jurisdictional Guidelines Test is waived, specific conditions may be attached to the grant of aid. This may include that the matter be allocated inhouse.

A decision that exceptional circumstances apply in a particular matter does not create a precedent for another matter.
