Duty Solicitor Service

The Commission provides a duty solicitor service to all the Magistrate and Youth Courts throughout the metropolitan area and in Mount Barker, Port Augusta and Whyalla. The Duty Solicitor is available to advise or represent people who have been arrested overnight, or who have not been able to obtain legal help beforehand. The service they can provide is limited. This usually involves applications for bail for persons in custody, obtaining adjournments/remands and conducting simple guilty pleas where there is usually no prospect of imprisonment such as for traffic offences and minor criminal offending.In some country areas, private lawyers are contracted to provide duty solicitor services on behalf of the Commission.

Prison Advisory Service

Duty solicitors also provide free advice to prisoners in metropolitan and country prisons. This involves such things as answering queries regarding sentences, parole issues, assisting with completing legal aid forms and referring prisoners to other agencies. Regular visits are made to the Adelaide Remand Centre, Yatala Labour Prison, Port Augusta Prison and Northfield Women's Prison to provide legal advice.
