Review of Mental Health Orders

Mental health orders are made under the Mental Health Act 2009 (SA) and heard before the South Australian Civil and Administrative Tribunal.

When a person is applying for review of the following mental health orders, they can tick the box on their SACAT application form to request legal representation:

  • a Level 1 Community Treatment Order
  • a Level 1 or Level 2 Inpatient Treatment Order (or Extension)
  • a SACAT decision to make a Level 2 Community Treatment Order
  • a SACAT decision to vary or revoke a Level 2 Community Treatment Order
  • a SACAT decision to make a Level 3 Inpatient Treatment Order, or
  • a SACAT decision to make an order for Electro-Convulsive Therapy.

We will then appoint a lawyer to represent the person under the SACAT Legal Representation Scheme.

Only the person who is subject to the Mental Health Order is entitled to be legally represented by us. We only represent clients who are referred to us by SACAT.
