Tenancy assistance

The Civil Law Division offers free legal assistance to applicants in relation to tenancy or residential parks disputes where the matter relates to:

  • retention of the applicant’s tenancy,
  • repairs to be conducted to make the property safe or fit for habitation, including any related rent abatement or reduction,
  • the applicant’s experience of domestic or family violence, or elder abuse, or
  • an apparent failure of the landlord or park operator to comply with the terms of any Act relevant to the tenancy or residential agreement.

Assistance may be offered to assist with the resolution of a matter or to represent an applicant in a court or Tribunal.

You must meet the Special Circumstances Criteria for a grant of aid to be approved, and where the matter is before a court or Tribunal, you must also meet the means test.

It is intended that the Legal Services Commission will primarily receive referrals for legal assistance from RentRight SA, who provides free housing advice and advocacy to tenants across South Australia.
